Resumen

This article deals with constitutional interpretation by discussing the meaning of the Constitution and who should be responsible for its interpretation. Although some believe the ideal constitutional interpretation is the one resulting from a collective process, which covers the institutional issue of who would have the authority to make such an interpretation, it is very common to treat such matters separately, and this is how the matter will be discussed in these pages – first, bringing to scene the problems related to the dominant interpretive strategies and, further on, discussing the issue of authority for constitutional interpretation.

Roberto Gargarella, University of Buenos Aires

Argentine lawyer, jurist, sociologist, writer and academic specialist in human rights, democracy, political philosophy, constitutional law and equality and development. He is currently a professor at the University Torcuato Di Tella and at the University of Buenos Aires, and is director of the Journal Revista Argentina de Teoría Jurídica (Argentine Journal of Legal Theory).
